*MUMBAI: A nominee of a property in a housing society does not automatically become the absolute owner of the property after the death of the original owner, the Bombay High Court has ruled in an important order.*

Delivering the verdict in a legal battle that has dragged on for over 29 years, Justice A P Deshpande said it would be the personal law of an individual that would determine the successor to the property and not the nomination under the Cooperative Societies Act.

"The Maharashtra Cooperative Societies Act (MCSA) does not provide for a special rule of succession altering the rule of succession laid down under the personal law,'' the judge said, citing two earlier judgments. *The court held that a nominee did not become the "absolute owner'' and was empowered only to hold the "property in trust for the real owners, that too for the purpose of dealings with the society''. A nominee has to give way to the legal heirs.*

The court's judgment came in a dispute over a 5,610-sq-ft plot at the Nav Rajasthan Co-Operative Housing Society in Pune bought by Shivram Sattur, who had named his wife Tarabai as a nominee.

Tarabai tried to sell the property after his death, but her four children sued her. Two subordinate courts upheld the sale agreement saying Tarabai had become the sole owner of the property as a result of the nomination.

*The HC, however, did not agree and said that her children also had a right over the plot as they were the legal heirs*.

The Hindu law says that on the death of a man, in case there is no will, the property is equally shared between the wife and the children. Muslims are governed by their personal laws.

*Under the MCSA, on the death of a member, the society can transfer the interest to a nominee or an heir or a legal representative. Such a nominee does not become the only owner, the HC said. The nominee represents the legal heirs of the deceased member while dealing with the cooperative society and is only empowered to act on behalf of the real owners. This is a temporary arrangement between the death of the member and till the court decides the legal heir who is entitled to the property or estate.*

The HC judgment has been stayed for eight weeks on a request from the developer who bought the property.

*NOMINATION FACTS*

(1) A society member can make a nomination, which can be revoked at any time

(2)- On the death of a member, the society transfers the shares to the nominee or the heir or legal representative

(3)- In case no nominee is mentioned, the society puts out a public notice inviting claims

(4)- The nominee is in charge of the property only till the court decides who is entitled to the property as per the succession laws
(5) This is not applicable for Maharashtra as it related to West Bengal as cooperative laws are state subject lot of discussions on the matter has been going on and recent judgement as below of Bombay high court may also be referred
(6) *The SC judgement is interpreting west bengal Co-operative society law. Succession in bengal is based on dayabhaga law whereas here in maharashtra succession is based on mitakshara law. There is therefore a difference in law of succession after death of owner. In my humble opinion the above SC judgement is not applicable in Maharashtra because law of succession is different here.* Moreover the above is interpretation of section 79 and 80 of WBCS act and rules 127 and 128 of WBCS Rules. The words used by WB legislature are interpreted.  The interpretation cannot be used to interpret the words used by maharashtra legislature.  (7) The S C judgment being referred wrongly by many, but  cannot be used in maharashtra.

Many social groups keep on recirculating the S C judgment  to say in a landmark judgment supreme court has declared nominee to be absolute owner.

The Bombay High Court (DB Headed by Abyay Oka J.) in Appeal No.313 of 2015, decided on 1.12.2016,  at paragraph Nos. 34, after citing several judgments, including the recent judgement of supreme court, has conclusively settled the law that
*nominee  does not get absolute title to the property subject matter of nomination. The reason is by its very nature, when a share holder or a deposit holder or an insurance policy holder or a member of a co-operative society makes a nomination during his life time, he does not transfer his interest in favour of the nominee. It is always held that the nomination does not override the law relation to testamentary or intestate succession. The provisions regarding nomination are made with a view to ensure that the estate or the rights of the deceased subject matter of nomination are protected till the legal representatives of the deceased take appropriate steps.... As observed by the Apex court, the legislative intention is not to provide a third kind of succession*
Its hoped the controversy is set to rest, once for all.

A Bench of Chief Justice Rajendra Menon and Justice Kameswar Rao clarified this position while quashing certain provisions of a 2016 circular which empowered registrars to cancel deeds if they were found to be fraudulently registered.

Appearing for the Areness Foundation, which challenged the circular, Advocate Sanya Kapur argued that in the absence of express statutory powers to this effect, registrars do not have the power to cancel registered deeds. To buttress her case, Kapur pointed out that the Supreme Court has already ruled that even the Inspector General has no power to cancel the registration of any document which has been already been registered. This was held in the 2016 case of Satya Pal Anand v State of Madhya Pradesh.

To the contrary, advocate Ramesh Singh had contended that registering authorities have inherent powers to cancel a deed if it is obtained by fraud. It was his case that the registrar’s “inherent” power to recall a deed in such cases could be traced, inter alia, to Section 82 of the Registration Act, 1908. This provision makes false impersonation, making false statements etc. a punishable offence. It was argued that when such a fraudulent deed is penalised and therefore liable to be treated as void, there is no need for the party to approach a civil court to get its registration cancelled.

The Court, however, disagreed, finding merit in the petitioner’s argument that the role of the Registrar ends once a deed is registered. The law in this regard, as already clarified in the Satya Pal case, is as follows:

(i) The role of Sub Registrar (Registration) stands discharged, once the document is registered.

(ii) There is no express provision in the Registration Act which empowers Registrar to recall registration.

(iii) The fact whether the document was properly presented for registration cannot be reopened by the Registrar after its registration.

(iv) The power of the Inspector General is limited to do superintendence of registration offices and make rules in that behalf. Even the Inspector General has no power to cancel the registration of any document, which has already been registered.

Therefore, the Court quashed the circular in so far as it gave the Registrar powers to cancel deed of registration.

“… in view of the clear exposition of law, the impugned circular issued, giving power to the Registrar to annul the registration is ultra vires the Registration Act…Accordingly, the circular dated July 13, 2016 to the extent it empowers the Registrar to annul a registered document is ultra vires the Registration Act, 1908 and is set aside.”

അകാരണമായി ഡിഫക്ട് നോട്ട് ചെയ്യുകയും, ഡിവിഷൻ ബെഞ്ചിന്റെ 2015 (5) KHC 703 റിപ്പോർട്ടഡ് കേസിലെ വിധിന്യായം ഉദ്ധരിച്ച് ഡിഫക്ട് ഇല്ല എന്ന് അഭിഭാഷകൻ സമർത്ഥിച്ചിട്ടു കേസ് നമ്പർ ചെയ്യാൻ വിസമ്മതിച്ച ഹൈക്കോടതി ഉദ്യോഗസ്ഥനെതിരെ നടപടി എടുക്കാൻ ഉത്തരവ്. ജസ്റ്റീസ് വിനോദ് ചന്ദ്രൻ, ജസ്റ്റീസ് അശോക് മേനോൻ എന്നിവരടങ്ങിയ ഡിവിഷൻ ബഞ്ചാണ് നടപടിക്ക് ഉത്തരവിട്ടത്. രജിസ്ട്രാർ ജനറൽ ഈ വിഷയത്തിൽ അന്വേഷണം നടത്തി നടപടി രണ്ടാഴ്ചക്കകം എടുക്കണമെന്നും അത് കോടതിയെ അറിയിക്കണമെന്നും ഡിവിഷൻ ബഞ്ച്. ചില ഉദ്യോഗസ്ഥരുടെ നടപടികൾ പരിധി വിടുന്നു എന്നും കേട്ടതി വാക്കാൽ നിരീക്ഷിച്ചു. അഡ്വ. അനിൽ S രാജ് ഫയൽ ചെയ്ത ഹർജിയിലാണ് ഉത്തരവ്. ഹർജി നമ്പർ ചെയ്യാനും നാളെത്തന്നെ പോസ്റ്റ് ചെയ്യാനും ഉത്തരവിൽ പറയുന്നു.

The Kerala Conservation of Paddy Land and Wetland Act 2008 - being butchered by its own creator, said Opposition Leader Ramesh Chennithala. The 2008 Bill passed by the then LDF Government was watered down by the incumbent LDF dispensation, Chennithala said in an article. The 2018 Kerala Conservation of Paddy Land and Wetland Act (amendment), which struck down the major provisions of the parent Act, was passed by the incumbent government abusing the mandate it received from the people of Kerala. 

The Act is widely perceived by intelligentsia and environmentalists as the most detrimental step to ecology. The provision laid down in the new Act destroys the heart and soul of the parent Act once touted as the Magna Carta in the History of Kerala legislature. This will pave way for the land grabbers and real estate mafia to reclaim paddy fields aggressively.   

The Paddy Land and Wetland Act 2008 was introduced to prevent indiscriminate reclamation of wetland/paddy fields, stop massive conversion of paddyfields and to promote agriculture in State. 
The 2008 Act, along with subsequent measures taken by governments had brought about an increase in the paddy cultivation in the first five years. More importantly, the Act had ensured further depletion of the Wetland and Paddy fields does not occur.

However, the 2016-17 economic review presents some startling statistics on the depletion in the paddy cultivation in Kerala. As per records, the area of paddy fields under cultivation plummeted from 1.9 lakh hectares to 1.7 hectares from 2015-16 to 2016-17 financial year while the total food production decreased from 5.49 lakh tonnes to 4.37 lakh tonnes. It is in this context the Kerala Conservation of Paddy Land and Wetland Act, 2008 gains profound importance.

The amendments to the Act alter 14 of the major clauses in the original Act and destroy the very purpose of the Act. The amendment brings in a new category of land ‘Unnotified land’ other than the existing lands paddy fields, wetlands, drylands mentioned in the original Act.  Unnotified land is land which is mentioned as paddy fields or wetlands in the Basic Tax Register, but isn’t notified as paddy fields or wetlands in the data bank created under relevant sections of the original Act. Ironically, after 10 years of its implementation, the databank has not been completed in most of the panchayats in the state. This provision renders the Act porous and opens it up for widespread exploitation for real estate mafia and land grabbers. The new Act also dilutes the authority of the Local Level Monitoring Committee by replacing its recommendatory powers to mere reporting powers. 

The government usurps the powers held by the local and district-level committees to become the sole decider for reclaiming wetlands and paddy field for ‘public’ purposes even without accessing the environmental impact assessments. The term ‘public purpose’ is liable to be exploited. The most dangerous provision in the new Act (Clause 15 , 27 c) allows the tahsildar to alter the revenue records which is in gross violation of the Supreme Court verdict. It is now the responsibility of all citizens to make sure the porous legislation is not overtly exploited by the land grabbers and real estate mafia. The UDF will continue its fight till the detrimental provisions are withdrawn through subsequent amendments, Chennithala said.

കേരള ഭൂപരിഷ്കരണ നിയമം ,Section 82 പ്രകാരം കേരളത്തിൽ ഭൂമിയ്ക്ക് സീലിംഗ് പരിധി

കേരളത്തിൽ സമ്പന്നർ അനിയന്ത്രിതമായി ഭൂമി വാങ്ങികൂട്ടുന്നത് തടയുന്നതിനായി
കേരള ഭൂപരിഷ്കരണ നിയമം ,Section 82 പ്രകാരം കേരളത്തിൽ ഭൂമിയ്ക്ക് സീലിംഗ് പരിധി നിഷ്കർഷിച്ചിട്ടുണ്ട് .അത് ഇപ്രകാരമാണ് .കേരളത്തിനുള്ളിൽ ഒരു 1)വ്യക്തിയ്ക്ക് ,മാക്സിമം 7 .5 ഏക്കർ. 2) 5 പേർ അടങ്ങുന്ന കുടുംബത്തിന് മാക്സിമം 15 ഏക്കർ .3) 5 പേരിൽ കൂടുതൽ ഉള്ള ഓരോ അംഗത്തിനും ഓരോ ഏക്കർ ,എന്നാൽ അംഗങ്ങളുടെ എണ്ണം എത്ര തന്നെയായാലും കുടുംബത്തിന് ആകെ 20 ഏക്കർ കവിയാൻ പാടില്ല .4) കമ്പനികൾക്ക് മാക്സിമം 15 ഏക്കർ ,അതിലധികം കൈവശം വയ്ക്കണമെങ്കിൽ Section 82 (3) പ്രകാരം സർക്കാരിൽ നിന്ന് ഇളവ് വാങ്ങണം .നിയമം ഇതായിരിക്കെ ,കേരളത്തിനുള്ളിൽ ,ഓരോ വ്യക്തിയും ,കുടുംബവും എത്ര ഭൂമി വാങ്ങിയിട്ടുണ്ട് ,എത്ര ഭൂമി കൈവശം വയ്ക്കുന്നു എന്നറിയാൻ യാതൊരു സംവിധാനവും നിലവിൽ ഇല്ല. നിയമപ്രകാരം സീലിംഗ് പരിധിയിലധികം കൈവശം വയ്ക്കുന്ന ഭൂമി മിച്ചഭൂമി യാണെന്നിരിക്കെ ,അത് കണ്ടു പിടിക്കാനുള്ള സംവിധാനത്തിന്റെ അപര്യാപ്തത കാരണം സർക്കാരിന് നാളിതു വരെ നഷ്ടപ്പെട്ടത് ലക്ഷകണക്കിന് ഏക്കർ ഭൂമിയും ,ഭൂരഹിതന് നഷ്ടപ്പെട്ടത് ഒരു തുണ്ട് ഭൂമി എന്ന സ്വപ്നവും:..

Easement. Pathway to our property

More than 60 years we are using a pathway which is belong to my neighbor, this is the only way to our land. On 1986 UDR survey the pathway is subdivided as pathway.but now the land owner object us to use the pathway. What can I do.

1) Section 13 of the Indian Easements Act deals with easement of necessity An easement of necessity means an easement without which the property cannot be used at all. Mere convenience is not the test of an easement of necessity. It can be claimed only when there is absolute necessity for it, i.e. when the property cannot be used at all without the easement and not merely where it is necessary for its reasonable, or more convenient enjoyment. A man cannot acquire a right of way as an easement of necessity, if he has any other means of access to his land however more inconvenient it may be than be passing over his neighbours 2) under section 35 of easement act you can obtain permanent injunction restraining your neighbour from obstructing your right of passage . pending hearing and final disposal of suit you can claim interim reliefs .

You have absolute right for using the pathway if it is used more than 20 + 2 years uninterruptedly and as of right . So you may approach civil court and seek injunction against the person who object the usage under the ground easement by necessity .So all the other person who used this path way can also join with you.

NO PROPERTY SALE ON POWER OF ATTORNEY: SUPREME COURT

No property sale on power of attorney: Supreme Court

Property sales through the common practice of general power of attorney (GPA) will not give ownership title to the buyer. 

In a landmark judgment that is expected to send a large number of property owners into a tizzy, the Supreme Court held that the GPA method of immovable property sales is not a valid form of transfer of property. 

A three-judge bench presided over by Justice R. V. Raveendran said that property can be lawfully transferred only through registered sale deeds. 

"A power of attorney is not an instrument of transfer in regard to any right, title or interest in an immovable property," the bench said, after interpreting various provisions of the law concerning property sales. However, the bench said the judgment will not affect "genuine transactions" under the GPA. 

The judgment delivered on Wednesday would have an impact on both freehold and leasehold properties and affect the mode of transfer of property in Delhi and the National Capital Region (NCR) where GPA sales are very common. Even though it can cause some hardship to those who have already purchased property through the GPA, the order will help curb evasion of duties, flow of black money into real estate and also save people from being cheated by unscrupulous owners selling the same property to several people. 

Navin Raheja, chairman and managing director of Raheja Developers said, "The court's decision will help to curb the circulation of black money to some extent in the real estate sector where titles are manipulated. Besides, many property transactions where prices are rounded off will be affected. However, overall there won't be any significant impact on normal property sales." 

The apex court said there can be no mutation of property in municipal and revenue records on the basis of such documents. The bench, however, clarified that its order should not be a ground for disturbing mutations already effected by the Delhi Development Authority (DDA) or any other authority. 

But, there is little relief for thousands of people who hold property without mutation as GPA sales can only be treated as existing sale agreements. An application of the order with prospective effect would have protected their interest. The court, though, stressed that it had merely reiterated the well- settled legal position that such transactions cannot be treated as completed transfers. 

The court could not make the order applicable with prospective effect as it had not laid down any new law. However, it said that those who had already bought property through GPA before its judgment could use the documents to apply for regularisation of allotments and leases by development authorities. "Nothing prevents affected parties from getting registered deeds of conveyance to complete their title. The said transactions may also be used to obtain specific performance or to defend possession under section 53A of TP (Transfer of Property) Act," the court said. 

In order to ensure that GPA continues to serve its purpose, the court said its judgment will not affect the validity of sale agreements and powers of attorney executed in genuine transactions. "For example, a person may give a power of attorney to his spouse, son, daughter, brother, sister or a relative to manage his affairs or to execute a deed of conveyance." 

The court further said that a person can enter into a development agreement with a land developer or builder for developing the land either by forming plots or by constructing apartment buildings. In that connection he can execute an agreement of sale and grant a power of attorney that will allow the developer to further sell the property to prospective purchasers. 

While hearing a matter on the subject, the court had decided to clarify the law on the issue as such transfers had not only led to evasion of stamp duty and registration charges but had also provided scope for investing black money in real estate. Besides, such transfers were giving nightmares to bona fide purchasers as the same property could be sold to several people in the absence of verification or certification of title. A proper verification of ownership was possible only if all property were transferred through registered sale deeds. 

Noting that such transactions were now not just limited to Delhi but had spread to neighbouring areas, the court had sought the views of the Centre and the states of Delhi, Haryana, Punjab and Uttar Pradesh. There was a near unanimity that such transactions should be discouraged as it caused loss of revenue and increased litigation due to defective titles. 

Going into the legality of such transfers, the court said any contract of sale which was not a registered sale deed would fall short of the requirements of the relevant provisions of the Transfer of Property Act and could not confer any title. The court said a transfer of property by way of sale could only be by a sale deed. "In the absence of a deed of conveyance (duly stamped and registered as required by law), no right, title or interest in an immovable property can be transferred," the bench said.
